Terms & Conditions

You are requested to read these terms and conditions before using the services of the HiProfile app. These terms and conditions are legal provisions set against the services and content including features, content, applications or widgets offered by HiProfile.

• By registering for and/or using the Service in any manner, including but not limited to visiting or browsing the app, you agree to all of the terms and conditions which includes HiProfile’s Intellectual Property Policy, Photo Guidelines, Privacy Policy, Venues, API License Agreement and all other operating rules, policies and procedures that may be published from time to time on the Site by HiProfile.
• Some services may be subject to additional terms and conditions specified by HiProfile from time to time; your use of such services is subject to those additional terms and conditions, which are incorporated into these Terms of Use by this reference. These Terms of Use apply to all users of the Service, including, without limitation, users who are contributors of content, information, and other materials or services on the Site, individual users of the Service, venues that access the Service, and users that have a page on the Service.
• HiProfile may offer to provide the services and which are to be selected by you, exclusively for your own use, and not for the use or benefit of any third party. Services shall include, but not be limited to, any services HiProfile incorporates for you; any applications or widgets offered by HiProfile that you download from the app or, subject to the terms set out under the third- party services authorized by HiProfile.
• You are free to browse through the app and view content without registering, but as a condition to using certain aspects of the Service, you are required to register with HiProfile and assure you provide authentic information including, but not limited to a user name, an e-mail address and/or mobile telephone number and a password to access the services and also update the information accordingly.
• In accordance with the country you reside and the applicable laws therein, HiProfile shall not offer its services to minors/children under the age of 13. In accordance with Article 8 of the GDPR, HiProfile shall not deliberately collect, process or store information of persons under the age of 13. Should you be under the age of 13, please do not attempt to register with our services (e.g. Site or Mobile Applications) or provide any Personal Information about yourself to us. If we learn that we have collected Personal Information from a child under the age of 13, we will promptly delete that information and exclude the said person from HiProfile’s services. If you believe we have collected Personal Information from a child under the age of 13, please Contact Us. We may limit how we collect, process and store some of the information of EU users between 13 and 16. For the safety of our users, we may limit access to certain functions to such users. The user must be old enough to consent to the processing of the user’s personal data in the user’s country (in some countries we may allow the users parent or guardian to do so on the user’s behalf). We rely on the accuracy of the information provided by our users. We cannot be held liable for any inaccurate information supplied to us.
• In accordance with the country you reside and the applicable laws therein, HiProfile shall limit the collection, processing and storing of information. Should the user be restricted in terms of the applicable laws within the country the user resides, please do not attempt to register with our services (e.g. Site or Mobile Applications) or provide any Personal Information about yourself to us. If you believe we have collected Personal Information of whom are restricted, please Contact Us. We rely on the accuracy of the information provided by our users. We cannot be held liable for any inaccurate information supplied to us.
• It is the responsibility of parents or guardians to ensure that the abovementioned is adhered to by their children/minors.
• We recommend, but do not require, that you use your own name as your user name so your friends can recognize you easily.
• You are requested to refrain from creating any account other than your own without the concerned person’s permission. You shall never create a fake profile using any other person’s identity and information.
• You are expected not to use a user name that is often regarded as unlawful or offensive. You will be solely responsible for any activity that occurs on your account and shall be responsible for maintaining the confidentiality of your HiProfile password.
• HiProfile reserves the right to refuse and cancel a User Name and other details in its sole discretion.
• You will be solely responsible for using your content including your photos, videos, audios, text, comments, graphics or any other content that can be used on the app. HiProfile will not be liable for any errors or omissions in any Content; and that HiProfile cannot guarantee the identity of any other users with whom you may interact in the course of using the service.
• The app includes content specifically provided by HiProfile or its partners and such Content is protected by copyrights, trademarks, service marks, patents, trade secrets or other proprietary rights and laws, as applicable. Express written permission from HiProfile is necessary to use any trademarks and logos belonging to HiProfile under any circumstances. These include and are not limited to:
  Any commercial use.
  – Use in a domain name or URL,
  – Use for merchandising or marketing purposes, e.g. on t-shirts.
  – Use of a name which includes the letters HiProfile in relation to
  computer hardware or software.
  Services relating to any of the above.

• Use, reproduction, modification, distribution or storage of any content for other than personal, non-commercial usage is strictly prohibited without prior consent from HiProfile.
• You are not allowed to sell, license, rent, or otherwise use or exploit any Content for commercial usage or in any other means that might violate any policies of a third-party and HiProfile.
• HiProfile may determine in its sole discretion, including but not limited to, publicly displaying content, reformatting it, incorporating it into marketing materials, advertisements and other works, creating derivative works from it, promoting it, distributing it, and allowing other users to do the same in connection with their own websites, media platforms, and applications of third-party media concerned.

Privacy policy and terms and conditions changes of HiProfile app is subject to the changes in the applicable laws in the user’s country of residence.

You agree, to the extent permitted by law, to indemnify, defend, and hold harmless HiProfile (PTY) LTD and its partners from and against any and all complaints, charges, claims, damages, losses, costs, liabilities, and expenses (including attorneys’ fees) due to, arising out of, or relating in any way to your access to or use of the Services, your content and your breach of these Terms. To the maximum extent permitted by applicable law, HiProfile (PTY) LTD and its partners shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the services; (ii) any conduct or content of any third party on the
services, including without limitation, any defamatory, offensive or illegal conduct of other users or third parties; (iii) any content obtained from the services; or (iv) unauthorized access, use or alteration of your transmissions or content.

Please Note: Breach of these Terms and Conditions may result in immediate termination of your HiProfile account without notice.
